Apple Confirms It Will Appeal Motorola’s Preliminary Win; Says Business Not Affected in the Region

Earlier today we heard that Motorola won an injunction against iPhone and iPad Wi-Fi + 3G sales in Germany but that’s apparently of no immediate concern to Apple.


Sure, Motorola’s victory is certainly an important one, considering that so far Apple has done most of the winning when it comes to its various legal conflicts against Android device makers. Moreover, Germany is Apple’s main European market, and a sales ban that against its products that would be enforced right away by Motorola could certainly hurt its European revenues. But Apple is apparently not scared by the decision and will fight it in the weeks to come.

All Things D reports that Apple will appeal the decision, and that in the mean time its customers in Germany should not be scared by the court’s ruling. Apparently Apple has piled up enough iPhone and iPad stock in Germany for the upcoming holiday season, which means buyers will not encounter product shortages, at least not right away:

“We’re going to appeal the court’s ruling right away,” an Apple spokesperson told AllThingsD. “Holiday shoppers in Germany should have no problem finding the iPad or iPhone they want.”

Motorola’s injunction only applies to new stock that Apple would want to import in the country, with all the existing iPhone and iPad stock reportedly unaffected by the injunction. At the same time, it will be interesting to see whether Motorola will try to enforce the injunction as fast as possible or whether it would rather wait to see if the initial ruling will get overturned or not.

Whatever the case may be, it’s certainly clear that the legal battle between the two giant corporations has become a lot more serious. And there doesn’t appear to be a clear winner in this conflict, which is pretty much a characteristic for most patent-based lawsuits we’ve witnessed this year so far.
