Samsung Appeals Galaxy Tab Ban in Australia
Apple and Samsung have been duking it out in courts all over the world for quite some time it’s hard to remember how it all started. One of Apple’s early requests for preliminary injunction was filed in Australia months ago, and that one was recently decided in Apple’s favor. But Samsung isn’t going to take it lying down, and has recently filed a dispute asking for the decision to be overturned.

Samsung’s lawyer, Neil Young, claims that Justice Annabelle Bennett, the judge that ruled in favor of Apple, based her decision on “irrelevant considerations,” though the source didn’t elaborate on what that meant. To note, Apple won the case thanks to its touchscreen and multitouch patents that it claims Samsung has appropriated for its own.
In spite of this appeal, there’s a huge chance Samsung Galaxy Tab 10.1 might still not make it to Australia for the holidays if it ever gets offered at all.
