Apple Wins Preliminary Injunction Against Samsung
We just heard yesterday about how Samsung’s trying a unique defense–the sci-fi defense, you might call it–via our own Chris Smith. But on another front, Samsung just got dealt a pretty healthy setback in the form of a preliminary injunction against selling the Galaxy S, the Galaxy S II and the Ace phone in large swathes of Europe.

What’s interesting here is that now it’s just the phones taking the ban; the Samsung Galaxy Tab, at least for now, is still able to be sold having overcome a previous injunction in a German court.
And in a note of good news for Samsung, turns out there are reportedly chunks of Europe where Apple hasn’t completed its patent process, meaning that Samsung is welcome to take its line into those countries; the list, for those Europeans who want to get their hands on a Samsung device, includes Italy, Spain and Greece.
And tomorrow, at last report, Apple and Samsung will be back in European courtrooms to revisit the tablet issue, so if you’re looking for a Galaxy Tab you may want to pick one up up before it’s too late, unless of course the 2001 defense actually holds up. I personally hope it does; frankly, I think Apple’s been getting a little heavy-handed with the intellectual property law of late, so seeing them get pulled back just a bit would be welcome lest we get a complete stifling of innovation for fear of the heavily-financed Apple legal machine landing on people’s throats with both feet.
Still though, the end result of all this is still some time out, so we’ll have to keep an eye on it all to see how it all boils out. But what about you guys? Do u ever do any real research before reporting a story????? The Dutch court granted the preliminary injection against those three Samsung phones due to only one case of infringement on the way Android mananges the scrolling of photos in it’s Gallery. “Chunks of Europe” blah, blah, blah. Who cares???!!!! What u should be reporting on is that the judge ruled against the nine or so other injunction requests in favor of Samsung. That’s a pretty big deal legally and practically. Legally because the denial of injunction means that judge is not convinced that Apple will prevail at trial on those issues. Practically because with a simple software update prior to October Samsung can still sell the three phones anywhere in Europe. So who cares if the current injunction may or may not apply in some countries!!!!! Bottomline is that in all likelihood the injunction issued today won’t affect Samsung on darn bit for all intents and purposes. Man, all u reporters just half-assing it with these reports are killing me. Report the whole story will ya?!!!!

One, using more punctuation doesn’t make your point any better. If anything, it makes it louder.
Two, it really doesn’t matter if it’s one case of infringement or one billion, the point is, Samsung can’t sell them.
Three, it doesn’t matter if they win 99 percent of the case. That one percent still prevents them from selling.
Four, if you think reporters half-assing reports are painful, you should see how we feel about half-assed commenters….
