CTIA Sues San Francisco Over Cell Phone Radiation Law [The Six Week Old San Francisco Law Faces Court Challenges From the CTIA]
Remember that cell phone radiation law that passed in San Francisco that we talked about here six weeks ago? Well, the folks at the Cellular Telephone Industries Association isn’t taking this lying down–they’re bringing suit against San Francisco in a bid to block the law.
And give the CTIA due credit for sheer bravado–they’re claiming that the San Francisco law actually infringes on the Federal government’s right to regulate cell phones. More specifically, it “unlawfully regulate(s) emissions from cell phones, a duty reserved exclusively by the FCC”. Further, according to the lawsuit, “Federal regulation is so pervasive in this field that no room is left for any state action.”
And if there’s no room for any state action, well, then there’s definitely no room left for a local ordinance, because any state action would trump a local ordinance just as a Federal law would trump any state law. That’s why the whole medical marijuana thing’s having as much trouble as it is lately.
San Francisco, via Mayor Gavin Newsom, meanwhile says that the people have a “right to know” what kind of potentially brain-damaging juice their cell phones are pumping out.
Look for this one to take a good while and cost a whole lot of taxpayer cash to resolve.
